Organisations, as of 2004, are equired to ensure that as a minimum the Statutory Disciplnary and Dismissal procedures are used when contemplating action short of and including dismissal. If they fail to do so then they run the risk of an automtaically unfair dismissal with an associated increase in any award made by the Employment Tribunal.

Managers can find it hard to use a formal procedure and we assist organisations with putting the necessary systems in place and then advise on the management of that process.

The correct handling of a written compliant or grievance by staff is now equally important. If you fail to handle it as you are now required to by statute, and an employee pursues you at Employment Tribunal, you risk losing your case.
